    The Digital Millennium Copyright Act

     

    If your copyrighted work is displayed illegally on a website, you may be able to take advantage of the Digital Millennium Copyright Act of 1998 (the "DMCA"), codified at 17 U.S.C. § 512, to convince the ISP to delete the infringing material from the ISP's servers or to prevent it from being accessed. The DMCA contains a procedure that grants "service providers" immunity from copyright infringement liability under certain circumstances when the infringement is caused by the service providers' users. Service providers include "a provider of online services or network access, or the operator of facilities therefor."

     

    Most ISPs probably do not want the potential liability that could result from having infringing content on their servers. The Digital Millennium Copyright Act provides that an ISP may be able to avoid copyright infringement liability arising from infringing content on a website hosted by the ISP for a customer if the ISP follows the procedures set forth in the DMCA. One way to get your copyrighted content off the internet is to notify the ISP that it has infringing content on its servers.

     

    The copyright owner may notify the website's host ISP of copyright infringement and demand that the ISP remove the infringing material from the internet and its servers. Under the notice and takedown procedure, a copyright owner must give a proper notice to the service provider’s designated agent. If, upon receiving a proper notice, the service provider promptly removes or blocks access to the allegedly infringing material identified in the notice and if certain applicable requirements of the DMCA have been satisfied, the service provider will be exempt from monetary liability arising from the infringement. The service provider is also protected from any liability to any person for claims based on its having taken down the material.

    The notice to the service provider of infringement must be given to the service provider's designated agent and must contain the following information:

    1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive copyright that is allegedly infringed.
    2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
    3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.
    4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
    5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
    6. A statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

    On receiving a proper notice of alleged copyright infringement, most ISPs will promptly remove or block access to the infringing material. Be sure to follow up with the ISP to make sure it complies with its obligations after receiving the notice.

  2. Bangkok is a no-brainer; can’t beat NEP. One can stay at the Nana Hotel right across the street, and be in the Plaza just seconds after leaving the hotel.

     

    Pattaya, OTOH, has to be learned. That isn’t to say it’s impossible to be learned, but one must figure out where everything is, and how to get there. The venues are spread out, and lots of time is spent just getting around. And if it rains, it really puts a damper on one’s holiday – no pun intended.

  3. Don't forget your 20% discount card from hillary group. Hillary 1,2,3...Morning Night, Climax, Ball in hand...and possibly that karaoke bar close to Guess....but watch your change in there. Mind you even with 20% off its still not a bargain beer outfit.

     

    Yeah, the problem with Hillary group isn’t just the change; they do a brisk business padding the bin as well.

     

    But don’t feel too bad, the staff also does good business stealing from the owners. That’s why they keep moving around their mamasans so much.

     

    BTW, that karaoke bar is indeed part of the Hillary Group, as is the new bar that just opened across the parking lot near Tequila Pub. Had a drink there last night. The mamasan (Joy) showed up at my table with a drink and put her chit in my bin. You should have seen the look on her face when I took it out and handed it back to her.

     

    I think my days of going to Hillary Group bars is pretty much over.


  4. I must admit, this is the first time in a long time where I've heard a positive promotion with little to no catch on the deal from Thailand.

    The norm is to raise the prices to increase profits (as opposed to marketing promo's and discount deals such as this).

     

    True dat. But I think it's a win-win situation for the bar and guys living here.

     

    I don't mind not getting the discount on BFs, but I think the may be taking the piss for not giving the discount on the watered down tequila they serve as LDs.

  5. The Nana Group (owners of Billboard, Anglewitch, DC-10, Las Vegas, and Nana (Liquid) Disco (arguably the best run bars on Soi 4)) is currently offering a VIP card entitling the holders to a 20% discount (not including barfines and ladydrinks) at the above mention venues.

     

    To receive your card, just go to the Nana (Liquid) Disco entrance in the Nana Hotel. Just to the right of the entrance into the disco, there’s a table with a register to enter one’s name, telephone number (not required) and email addy. Once the information is entered in the register, the girls will hand over the VIP card. Easy peasy.

     

    Last night my check bin was 1,200 THB at DC-10 and 2,500 THB at Billboard. The 20% discount was a nice touch.

    this is a govt hospital that is a major part of all the international STD programs for Thailand, especially HIV/Aides. they were one of the first in Asia to sign on to the International effort to figure all this out and that is all they do there. i have been several times for my periodic check-ups. very friendly, very matter of fact, and no bs or attitude was ever expressed to me on either visit.

     

    they will check everything.

     

    NOTE: the posters on the walls of this place may have you grabbing your junk and running for the hills. very graphic depictions of what STDs can do when they ravage your body. these STD posters make the pictures on the cigarette packs look appealing. but at least you will know what you are up against the next time you get naked and start thinking about stabbing the black peanut BB.

     

    these people conduct the most thorough tests known to the medical profession anywhere. they have always been in the forefront of the cause to reduce STDs.

     

    they are also very inexpensive as it is mainly a place for Thais.

     

    take the BTS to Chong Nonsi Station on the Silom line. as shown in the map below. if you call them simply ask for an English speaker if one does not answer the phone.

    How’s their English at the hospital? Is the STI Clinic a sub-section of the hospital? If so, where’s it located?

     

    About three weeks ago, went to BNH complaining of Urethritis and wanting an HSV test. The urologist just refused the HSV test request saying that HSV testing in Thailand was unreliable. I wasn’t completely surprised because I’d heard the same thing at Rangsit General Hospital and Thammasat University. When I pressed him on it, he said, “In Thailand it’s complicated.” I paid 1,100 THB for that meeting (700 for the doctor, 200 for the nurse, and 200 for lab work).

     

    Leaving BNH, I thought to give Bumrungraad a shot. The urologist there also refused saying HSV testing in Thailand was unreliable. Although I had heard that before, I figured if anyone did the testing in LOS, it would be BNH or Bumrungraad. Anyway, paid 1,750 THB for the visit, but don’t have the breakdown.

     

    Gotta go back to BNH to get the lab work results on Monday. Depending on the outcome, may give Bang Rak a visit sooner rather than later. Either way, Bang Rak Hospital, STI Clinic does indeed sound like a good place to go.

    Que Pasa may or may not be the restaurant that you're looking for, but you won't find a better Mexican restaurant in the area. And for *my* money it's one of the best outside the US and Mexico. It's that good.

    This afternoon, I decided to tag along to the GF's factory in Pathum Thani. After work we took the long way home and shot a couple buckets of balls at the Baiyoke Sky driving range before stopping by Que Pasa for dinner.

     

    The interestng thing was that although we approched Que Pasa through Pak Kret, many industrial parks in the area advertised as Pathum Thani industrial parks. When I asked the GF about that, she said that Pak Kret is 50/50 in Bangkok, and 50/50 in Pathum Thani.

     

    I wouldn't say the food is Tex-Mex, but the owner is a farang from Texas. Hope that helps.


  8. Found myself stuck in traffic yesterday, and thought to play around a little with my GPS.

     

    According to the Garmin GPS and Google, the closest Mexican restaurant to Pathum Tani is called Que Pasa, and is located in Nonthaburi (about 19 clicks south of Pathum Thani). One can have a look at their Website here: http://www.quepasa-th.com/Que_Pasa/Que_Pasa.html

     

    Didn't notice a Curios section on their site, but they do indeed offer catering.

     

    Que Pasa is now on my list to check out the Mexican food *and* the pizza.

     

    As it's located a bit south of Pathum Thani, Que Pasa might not be the one you're looking for. But it's worth a shot.

     

    If you *do* find the restaurant in Pathum Thani, please let us know.

    I'd have been pretty pissed about that. IMO that's reason enough to check-out ASAP and find a new place to hang.

  13. Does anyone else cover up for oral?

     

    Lot's of people do. That's why so many minimarts here sell flavored condoms.

     

     

    Side note, and I think I posted this somewhere else here - if you're in the provinces and take Doxycyclene as an anti-malarial, that *may* provide some protection against STDs other than HIV. But I'm no doctor, so do your own research on that.

     

    Taking Doxycycline as a Chlamydia prophylaxis is a double-edged sword; although it might work sometimes, some think it may actually increase the chance of becoming infected with Doxycycline/Tetracycline resistant bacteria, which might be much worse.

     

    And Doxycycline won't do anything to protect one from Herpes (which doubles one's odds of contracting HIV) or even worse, MRSA (which if it isn't bad enough on it's own, ups the odds of contracting HIV considerably).

    As an oversimplified general rule, I don't drink until the sun goes down... An easy rule to stick to in Bangkok, but a little more difficult for me in Patters.


  15. Hannover has some good Thai restaurants also, but my experience is that a lot of Thai restaurants in Germany are run by Asians that can't speak Thai.

     

    One exception is the Thai restaurant near Hannover's RLD. It's owned by a German guy and his Thai wife. I'd take a couple girls out from the Thai houses, and we'd all have a party. Considerably more expensive than Thailand, but the beer was better!

  16. I guess that I'm lucky. There are several great Thai places in the SF Bay area.

     

    The SF Bay Area (as well as Los Angeles) has some of the best Thai restaurants on the planet outside Thailand.

     

    Both areas also have several Thai wats, and some of the wats also have Thai food courts.

     

    If you're not doing anything on a Sunday afternoon, check out the Thai wat in Fremont. They have a nice little food court there; it's a great place to hang out. Keep your eyes open for a few LBs that frequent the wat, but getting to know them can be slow going.
